Terms of Service
These terms govern your use of the Kataleptic inference API. They are deliberately short and written to be read. If something here surprises you, write to [email protected] before signing up.
§ 01The parties
"Kataleptic", "we", "us" is the brand under which
DLabs SpA — a Sociedad por Acciones
organised in the Republic of Chile — operates the inference API at
api.kataleptic.com and the website at
kataleptic.com. Kataleptic is a product of the
DuguetLabs umbrella; the contracting party for these Terms is
DLabs SpA. Payments are processed by Dodo Payments acting as
Merchant of Record.

"You" means the person or organisation that signs up for an API key and uses the service. You confirm you are at least 18 years old, or have the consent of a parent or guardian, and have the legal capacity to enter into these terms.
§ 02The service
Kataleptic operates an OpenAI- and OpenRouter-compatible HTTP API for running inference on a curated catalogue of large language models (twenty-five models at time of writing — DeepSeek, Llama 3.x and 4, Mistral, Kimi, Gemma, GLM, Qwen, Phi-4, Cohere, Grok, the GPT-5 family, and embeddings). The current catalogue and prices are published at kataleptic.com/#pricing and api.kataleptic.com/v1/models.
We act as an intermediary: we route your requests to upstream providers (Microsoft Azure AI Foundry, Microsoft Azure OpenAI, and dedicated GPU servers we operate). The upstream providers' acceptable-use policies apply in addition to ours.
§ 03Your account and key
Sign-up requires a valid email address. We issue an API key prefixed
dg_. Your key is your account. Anyone who
possesses it can spend your credit. Treat it like a password: do not
share it, do not commit it to public repositories, and rotate it if
leaked by emailing us.
You are responsible for all usage on your key, including by anyone you share it with, until you tell us to disable it.
§ 04Acceptable use
You may not use the service to:
- generate or distribute content that is illegal in Austria, the European Union, or the jurisdiction where the content is consumed;
- generate child sexual abuse material, content sexualising minors, or non-consensual intimate imagery;
- conduct mass disinformation, deceptive impersonation, or election manipulation;
- build malware, spyware, surveillance tooling, or coordinated harassment systems;
- infringe intellectual property, defame, or stalk identifiable individuals;
- scrape, resell, or sublicense the API as a wholesale "model provider" service (you may build products and applications on top of it; you may not relabel the raw API as your own marketplace);
- circumvent rate limits, abuse free-credit signups, or attempt to extract model weights or training data;
- generate content that violates the Microsoft AI Code of Conduct, which applies to traffic routed through Azure backends.
We may inspect request metadata (timestamps, model, token counts, IP) to enforce these terms. We do not log prompt or completion content unless investigating a specific abuse report.
§ 05Your content, our outputs
You own your inputs. Prompts you send remain yours. You grant us only the limited licence needed to run them through the upstream model and return the response.
You own the outputs to the extent the model's licence permits, with two caveats: (i) language-model outputs may not be copyrightable in many jurisdictions; (ii) you remain responsible for the legality of how you use them.
We do not train on your traffic. Prompts, completions, and embeddings sent through Kataleptic are not used to train any model. Upstream providers' policies on training are stricter than typical commercial APIs — we use enterprise tiers that contractually exclude training on customer data.
§ 06Fees, credit, and billing
The service is sold on a prepaid credit model. New accounts receive five US dollars of starter credit at no cost. Each API call deducts credit at the per-million-token price published for the chosen model at the time of the call. We round up to the nearest whole token.
Once your credit is exhausted, requests return HTTP 402 until you top up. Top-ups are charged via our payment processor. Credits do not expire while your account is active. Refunds are governed by our Refund Policy.
Prices may change with at least 14 days' notice by email. Existing credit is honoured at the prices in effect when consumed.
§ 07Availability and changes
We aim for high availability but do not currently offer a contractual uptime SLA on the free tier. We may add, remove, or change models in the catalogue. We will give at least 30 days' notice before fully retiring a model, except when an upstream provider deprecates it sooner — in which case we pass on whatever notice we receive.
§ 08Suspension and termination
You may close your account at any time by emailing us. We will refund unused credit per the Refund Policy.
We may suspend or terminate your account if you breach these terms, if your usage threatens the stability of the service, or if we are required to by law. We will tell you why, in writing, unless doing so is itself prohibited.
§ 09Warranty disclaimer
The service is provided as is. Language-model outputs can be wrong, biased, or hallucinated. Do not use them for medical, legal, financial, or safety-critical decisions without independent verification. We make no warranty of fitness for any particular purpose.
§ 10Limitation of liability
To the maximum extent permitted by law, our total liability under these terms is limited to the amount you paid us in the twelve months preceding the claim, or one hundred euros, whichever is greater. We are not liable for indirect, consequential, or incidental damages, or for loss of profits, data, or goodwill.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, gross negligence, death, or personal injury caused by us.
§ 11Governing law and disputes
These terms are governed by the laws of the Republic of Chile, excluding its conflict-of-laws rules. Disputes will be resolved in the competent courts of Santiago, Chile, except where mandatory consumer-protection law of your country of residence requires otherwise.
Payments are processed by Dodo Payments as Merchant of Record. Their terms apply to the payment transaction itself; ours apply to use of the inference service. Refund and chargeback handling is described in our Refund Policy.
If you are an EU consumer, you may use the European Commission's Online Dispute Resolution platform; we are not obligated to participate.
§ 12Changes to these terms
We may update these terms. Material changes will be announced by email at least 14 days before they take effect, and the effective date at the top of this page will change. Continued use after the effective date is acceptance.
